With this "Clarification Text," KONAK OTELCİLİK VE TURİZM ANONİM ŞİRKETİ ("KONAK OTEL") would like to inform and enlighten you regarding the processing of personal data in accordance with Article 10 of the Law No. 6698 on the Protection of Personal Data (“GDPR”), the transfer of your processed personal data, the methods of collecting your personal data, and the legal reasons, as well as your other rights listed in Article 11 of GDPR. We express our utmost sensitivity regarding the confidentiality and security of all personal data you provide us and state that all necessary technical and administrative security measures have been taken to protect this data.

Status as Data Controller

As KONAK OTEL, we will record, store, process, classify, and update your personal data in a manner compliant with the law and principles of honesty, within the scope of the purposes stated below, and we will inform and transfer these data to third parties to the extent permitted by the relevant legislation regarding GDPR.

Purpose of Processing Your Personal Data

Your personal data is processed in accordance with the basic principles regulated in GDPR and related legislation so that you can benefit from the services provided by KONAK OTEL, based on your explicit consent and/or depending on the legal regulations we are subject to, as well as other circumstances foreseen in Article 5/2 of GDPR. Considering the services provided by KONAK OTEL, your personal data is processed in the processes related to our business relationships and in the continuation of the Company's commercial activities, as indicated in the attached Excel document. Your personal data is securely stored in physical and electronic environments for an appropriate period of time in accordance with the purpose of processing. In this regard, KONAK OTEL acts in compliance with all legal obligations, primarily GDPR.

Methods and Legal Grounds for Collecting Your Personal Data

Your personal data is collected by KONAK OTEL through various channels to meet your needs and conduct our activities.

Personal data provided directly by you to KONAK OTEL: All information and documents you have submitted to us.

Personal data provided to KONAK OTEL through an agency or company: All information and documents communicated to us about you.

Your personal data may be collected automatically or non-automatically, in written, verbal, or electronic form through KONAK OTEL.

In this context, your personal data may be processed and transferred without obtaining your explicit consent in the presence of the situations specified in Articles 5/2 and 6/3 of GDPR, or by obtaining your explicit consent in accordance with the principles set forth in Article 4/2 of GDPR.

Transfer of Your Personal Data

KONAK OTEL may share your personal data obtained for the above-mentioned processing purposes, based on your explicit consent or in accordance with the relevant legislation as stated in Article 5/2 of GDPR, with our group companies, direct/indirect business partners, suppliers, independent auditing firms within the legal limitations, or public institutions or organizations entitled to request this data due to a legal obligation, limited to the relevant institutions and organizations.

Transfer of Personal Data Abroad

Your personal data may be transferred by KONAK OTEL upon obtaining your explicit consent in accordance with the regulation set forth in Article 4/2 of GDPR, or without obtaining explicit consent in the presence of the situations stated in Articles 5/2 and 6/3, and only to foreign countries that the Personal Data Protection Board (“Board”) will announce as having adequate protection according to Article 8 of GDPR. For countries that do not have adequate protection, data may only be transferred if both the data controllers in Turkey and in the relevant foreign countries provide a written commitment to ensure adequate protection, and permission is obtained from the Board.

Your Rights Under Article 11 of GDPR

Firstly, it is important for KONAK OTEL, due to the nature of our commercial activities, that the personal data we process and/or store is accurate and up-to-date. Therefore, we kindly request you to inform us as soon as possible if there are any changes to your personal data.

As a personal data owner, you have the following rights under Article 11 of GDPR, except in the cases specified in Article 28 regarding "Exceptions":

To request information if your personal data has been processed,

To learn the purpose of processing your personal data and whether they are used in accordance with this purpose,

To know the third parties to whom your personal data has been transferred, either domestically or abroad,

To request the correction of your personal data if it is incomplete or inaccurately processed,

To request the deletion or destruction of your personal data under the conditions specified in Article 7 of GDPR,

To request that your deletion or destruction requests be communicated to third parties to whom your personal data has been transferred,

To object to a negative consequence arising from the processing of your personal data exclusively through automated systems,

To request compensation for damages incurred due to the unlawful processing of your personal data.

In this context, when exercising your rights, you are required to submit your requests to KONAK OTEL in writing or by the methods defined by GDPR. You can personally apply with your identity-determining documents and a written petition containing your explanations regarding the right you wish to exercise at our address: Cumhuriyet Cad. No:75 34437 Elmadağ, Taksim-Şişli Istanbul, or you can send your request to KONAK OTEL via a notary public or a secure electronic signature.

As a personal data owner, it is understood that you have read and accepted the above Clarification Text regarding the Processing of Personal Data before performing any transactions on KONAK OTEL's website or through KONAK OTEL employees, and you will be deemed to have consented to the processing and sharing of your personal data obtained by making transactions on the website or through KONAK OTEL employees irrevocably.
